Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MessageFit (“the App”). By downloading, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the App.
1. Use of the App
MessageFit is a mobile app offered on a freemium basis. You may use the core functionality of the App for free, and optionally subscribe to a Premium version to unlock advanced features.
You agree to use the App only for lawful purposes and in accordance with these Terms.
2. Eligibility
MessageFit is intended for users 18 years and older.
We do not knowingly collect data from minors. If you are under 18, do
not use the App. We are not responsible for any unauthorized use by
minors.
3. Subscription and Payments
Some features are available only through a paid Premium subscription. Subscription fees are processed through the app store (Apple App Store or Google Play), and are subject to each platform’s billing terms.
All sales are final. We do not offer refunds except where required by law.
4. User Conduct
You agree not to misuse the App, including but not limited to:
- Attempting to reverse engineer, decompile, or disassemble any part of the App
- Engaging in automated access, scraping, or denial-of-service (DoS/DDos) attacks
- Uploading or distributing malicious code or software
- Attempting to interfere with the App’s security or functionality
- Using the App in a way that violates applicable laws or regulations
- Attempting to bypass, disable, or “jailbreak” the AI models or safety systems.
- Attempting to prompt the AI models to generate explicit, sexual, hateful, political, violent, or otherwise prohibited content.
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, in the event of abuse or any behavior we deem harmful to the service or other users.
5. Modifications to the App
We reserve the right to modify, suspend, or discontinue any part of the App, including features and functionality, at any time, without notice.
We may also update these Terms from time to time. Continued use of the App after changes have been made constitutes acceptance of the updated Terms.
6. Disclaimer of Warranties
The App is provided “as is” and
“as available” without warranties of any kind.
We make no guarantees regarding the accuracy, completeness, or
reliability of nutritional information provided by the App.
You understand that calorie tracking is a general tool and not medical advice. Always consult a healthcare professional before making significant changes to your diet or lifestyle.
7. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any damages or losses arising from your use of the App, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
You use the App at your own risk.

9. Apple-Specific Terms (iOS Only)
If you are using the App on an Apple-branded product, you and the App Provider acknowledge and agree that:
- This EULA is between you and the App Provider only, not Apple. Apple is not responsible for the App or its content.
- The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and Usage Rules.
- The App Provider is solely responsible for providing support for the App. Apple has no obligation to furnish any maintenance or support.
- In the event of any failure of the App to conform to any warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- The App Provider, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability, legal compliance, or claims under consumer protection laws.
- In the event of any third-party claim that the App infringes their intellectual property rights, the App Provider is solely responsible for the investigation, defense, and settlement of such claims.
- You represent that you are not located in a country subject to U.S. government embargo or on any U.S. government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the App.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, have the right to enforce it against you.
